‘Walang pananagutan’: Law dean says Angel Locsin not liable for death of elderly man

Far Eastern University (FEU) Law Dean Mel Sta. Maria took to Facebook to clarify that Angel Locsin is not liable for the death of an elderly man at the community pantry organized by the actress.

 

 

In a lengthy Facebook post, the law dean made a comprehensive explanation as to why there is no basis for anyone to file a criminal negligence charges against the Kapamilya actress. 

According to Sta. Maria, Angel’s “act” of putting food on the table does not constitute a crime since the death of the 67-year-old man was never part of her intention.

“PARA MALINAW LANG NA WALANG PANANAGUTAN SI ANGEL LOCSIN. Sabi po ng iba criminal negligence daw ang pwedeng ikaso kay Angel Locsin. Mali po iyon. Ayon sa ating BATAS kriminal, ang reckless imprudence o ang simple negligence ay  nagmumula sa ‘ACT’ ( Article 365 of the Revised Penal Code), sa ating wika -- KILOS,” he said. 

 

 

“Halimbawa, pawarde-warde kang mag-drive sa iskinita, negligent act iyon. Kung makabangga ka, mananagot ka kasi sa kilos o ‘Act’ mo na pawarde-warde may napinsala. Naging pabaya ka sa iyong mga kilos. Hindi ka naging maingat. Ang ginawa lang ni Angel (o ng mga kasama niya) ay maghanda ng mesa at lagyan ng food at iba pang goods ang mesa. Iyon ang kilos niya,” he added.

He continued: “’YUNG sumunod na pangyayari, kamukha ng pagpila ng mga tao, o may sumingit sa linya at medyo nagkagulo, HINDI Kilos o ‘Act’ ni Angel iyon. Walang ‘Act’ si Angel na pinagbuhatan ng napinsala o namatay. Hindi siya mananagot under the Revised Penal Code. Sa pagpapatupad ng batas na criminal, it must be strictly construed. Sabi ng batas, reckless imprudence is when a person ‘shall commit any ACT which, had it been intentional, would constitute’ a crime. Ang paglalagay ng mesa at pagkain ay ‘Act’ o kilos na hindi crime.” 

 

 

Talking about civil law, Sta. Maria also explained that there are no grounds to file a civil case against Angel. 

“Sa usaping civil ( hindi criminal), iba ang negligence. Tinutukoy nito ‘act or omission,’ sa ating wika — kilos o walang kilos. Malinaw ito sa Article 2176 ng Civil Code. Ibang iba sa criminal law. Madami ang nagkakamali, na-interchange nila ang criminal law at civil law. Hindi ko sila masisisi kasi baka hindi naman sila abugado. Si Angel ba may ‘omission’ na pinagbuhatan ng kapinsalaan ng mga iba? ANG Sagot WALA rin. Sapagkat, sa usaping ‘omission’, dapat alam mo ang promixate cause na tinatawag — ito ang pinaka efficient cause ng pinsala,” he said.

Sta. Maria went on to explain that the moment the person decided to go to a place without any knowledge of what will happen, that person should know that there will be risks involved — something that’s out of Angel’s hands. 

“Kung nagsapalaran ang isang taong pumunta sa lugar na hindi niya rin alam ang mangyayari, nag-assume siya ng risk sa mga mangyayari doon. Wala ng kinalaman si Angel dyan. Hindi mapapanagot yung ibang tao na naglagay lang ng mesa at pagkain,” he remarked.

 

 

Sta. Maria went on to reiterate that it’s simply absurd to blame Angel since people came for the food Angel prepared and not the actress herself. 

“‘Yung mesa at pagkain na nilagay ni Angel, iyon ang nilalapitan. Masyadong malayo na panagutin si Angel sa lahat ng mga nangyari sa mga taong nagsapalaran na pumunta  doon. Kung ganun ang interpretasyon, eh kahit kagat ng lamok ng nakapila, mananagot si Angel. Mali iyon. Absurd iyon. Walang ‘omission’ si Angel Locsin. Kaya sa batas, whether civil o criminal, walang pananagutan si Angel Locsin. Sana po malinawan ang kinauukulan,” he said. 

With several theories coming, out of the incident that transpired in attempts to implicate Angel, Sta. Mari once again explained that the actress-philanthropist’s move to invite people to her community pantry does not constitute a crime. 

“PARA LANG MA-IMPLICATE si Angel Locsin, ang dami ng weird theories na lumalabas. May narinig ako at nabasa na ang kasalanan daw ni Angel Locsin ay nag-invite siya. LINAWIN lang po natin, hindi po krimen ang pag-imbita. Kung inimbita ninyo ang kaibigan ninyo sa party at nung papunta sa inyo, nadapa at namatay, hindi po kayo mananagot,” he said.

“Muli po, sabi po ng batas ang criminal negligence ay when a person ‘shall commit any ACT, which, had it been intentional, would constitute’ a crime. (Article 365 of the Revised Penal Code). ‘Yung pagiimbita kahit na po intentional, hindi po crime. Iyan lang po ang katotohanan. Mayroon pa kayang out-of-this-world theories na lalabas,” he added. 

Mel Sta. Maria is highly regarded in the academe particularly in the field of law.
