Nicko Falcis remained indignant about his allegation that a Taguig court has issued a “biased” decision in favor of his former business partner, Kris Aquino, via a series of new tirades on Intagram last Wednesday, March 13.
The accountant, who faces charges of 44 counts of theft in six different courts in Manila including Taguig, insisted that he was wrongly charged by the Office of the City Prosecutor of Taguig City with Estafa through Misappropriation and Conversion—a claim that is strongly supported by his counsel, Ponferrada-Ty Law Offices.
We emphasize that the charge alleged unauthorized use of a measly P62,784.32 amount and does not even detail what the charges are for, why these are unauthorized, and does not explain why no demand was made for an explanation prior to filing. “In fact, Estafa was not even charged against our client in the preliminary investigation proceedings before the [Taguig OCP]. In any event, our client did not commit Estafa and/or violation of Section 9(j) of Republic Act No. 8484, as he even issued a personal check in the amound ₱437,595.67 to resolve any alleged issue, even though the alleged issues were clearly without basis,” stated his lawyer.
Furthermore, the said court has made contradicting statements in its official decision which is enough to question its credibility to issue a fair judgment, according to Nicko.
“This is what happens when you rush your decision by drafting in a biased manner! The prosecutor should inhibit given she [Assistant Prosecutor Claire Eufracia Pagayanan] was appointed by PNoy on January 8, 2016 as Prosecutor II in Taguig,” he said.
“We do not need background sounds nor your registered mail drama with your divine justice league. We read, study, and carefully answer all the developments of the forum shopping Kris Aquino made per city. We will fight this, online and offline, to end this #Krisis,” he added.
On February 11, the Taguig court officially dismissed Kris’s qualified theft charges amounting to ₱62,784.32 versus Nicko on accusations of alleged fraud using the company credit card of her production company, Kris C. Aquino Productions (KCAP).
However, the resolution found a substantial evidence to charge Nicko with Estafa through Misappropriation and Conversion, to which the latter immediately responded with an Omnibus Motion to dismiss the case.
