Reckless Imprudence case against Richard Gutierrez gets dismissed

 

Richard Gutierrez wasn’t able to hide his relief upon finding out that his reckless imprudence resulting to homicide case has been junked by the Silang-Amadeo Cavite second municipal circuit court.

Penned by Judge Maria Luwalhati Cruz, the June 30 resolution ruled that the prosecution wasn’t able to present enough evidence to convict the actor. 


It may be recalled that Gutierrez got embroiled into a vehicular accident in 2009. The actor, who was driving his car at that time, crashed into a concrete post and three coconut trees along the Sta. Rosa-Tagaytay Road in Silang, Cavite. 

This supposed overspeeding incident led to the demise of his personal assistant Nomar Pardo and his bodyguard, who were his passengers at the time.

“He is happy that the court concurred with his claim that the incident that happened last May 2009 was a pure ‘accident.’ Walang may gusto nun. In fact, he was also injured as a result of said accident,” said Gutierrez’s counsel Atty. Marie Glen Abraham-Garduque in an interview with PEP.

She assured that Gutierrez is not happy of the fact that his assistant passed away because of the incident.

“He will forever grieve and sympathize with the family of Nomar,” she added.

One of the supposed factors that led to the case’s dismissal was the fact that the prosecution was only able to present one witness in the person of the complainant, the wife of the deceased personal assistant, Lorayne Pardo.

“Her testimony was presented for the purpose of proving that she is the wife of the deceased and that she was the one who filed the criminal case against Richard. She was not in the scene of the alleged crime when the incident happened,” Atty. Abraham-Garduque shared.

What’s more, according to the La Luna Sangre’s lawyer, is that Pardo’s wife belatedly found out about the incident.

“She admitted that she just learned of the accident only at 5am when Monching [Richard’s half-brother Ramon Christopher] called her and that she just arrived at the hospital at 7am,” the lawyer said.

“Thus she has no personal knowledge to prove that Richard was over speeding or he drove his car in a reckless manner in total disregard of traffic rules, laws and municipal ordinances,” she added.

While Gutierrez has met with Pardo’s widow for a number of times to reach an “amicable settlement,” according to Atty. Abraham-Garduque, they have yet to arrive at an agreement.

Even though Gutierrez is ready to move forward, his lawyer stressed that there is no reason for the star not to meet with Pardo’s widow anew to come up with an agreement in the futur
